MSME Samadhaan and ODR: prepare before you file

Samadhaan, MSEFC and the newer ODR process

MSME Samadhaan was created to route delayed-payment applications to the relevant Micro and Small Enterprises Facilitation Council. The Ministry subsequently introduced an online dispute-resolution scheme and portal for delayed-payment matters. Current procedures should be checked on the official portal before filing.

Pre-filing checklist

1. Eligibility: confirm Udyam status, enterprise classification, activity and registration timing.
2. Buyer identity: verify the legal entity, registered address and contractual counterparty.
3. Contract: organise the purchase order, work order, agreement and payment term.
4. Acceptance: preserve delivery, completion, sign-off and communications showing acceptance or objections.
5. Amount: reconcile invoices, taxes, credit notes, partial payments and outstanding principal.
6. Communications: create a dated chronology of reminders, disputes and payment promises.
7. Relief: separately state principal, claimed interest and the basis of calculation.

When to seek professional help

Get professional advice where the buyer disputes quality or delivery, the contract has an arbitration or jurisdiction clause, the registration timing is uncertain, limitation may be approaching, multiple entities are involved, or a substantial interest claim is being made.
